Terms of Service

Last updated: August 26, 2026

These Terms of Service (“Terms”) govern access to and use of the ContextGuard website, platform, and related services (collectively, the “Service”), operated by ContextGuard (“ContextGuard”, “we”, “us”). By creating an account, deploying the Service, or otherwise using it, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent (“Customer”, “you”).

1. The Service

ContextGuard is a data loss prevention gateway for LLM traffic: it sits between your applications or users and language model providers, scans prompts and responses against policies you configure, and can block, redact, or log violations. The Service may be self-hosted in your own infrastructure or accessed as a hosted deployment we operate on your behalf, as described in your order or deployment documentation.

2. Accounts and Eligibility

You must provide accurate information when creating an account and are responsible for safeguarding admin keys, API keys, and any other credentials issued to you. You are responsible for all activity that occurs under your account and for promptly notifying us of any unauthorized use.

3. Acceptable Use

You agree not to, and not to permit others to:

  • Use the Service to violate applicable law or the rights of any third party;
  • Attempt to bypass, disable, or interfere with the Service’s detection, redaction, or access-control mechanisms other than through supported configuration;
  • Probe, scan, or test the Service’s security other than as expressly authorized (for example, under a written penetration-testing agreement);
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent applicable law expressly permits;
  • Resell or sublicense the Service without our prior written consent.

4. Customer Content and Data

“Customer Content” means the prompts, responses, files, and other content that passes through the Service as part of your use of it. As between you and ContextGuard, you retain all rights to Customer Content. You grant us the limited right to process Customer Content solely to provide, secure, and support the Service — including scanning it against your configured policies and producing audit and compliance records as your policies direct.

For self-hosted deployments, Customer Content is processed within your own infrastructure and is not transmitted to us except where you configure an integration (for example, a hosted model provider) that requires it. See our Privacy Policy for how we handle data in hosted deployments and on this website.

5. Subscriptions, Trials, and Payment

Paid plans are billed in advance on the cycle stated in your order. Fees are non-refundable except as required by law or expressly stated otherwise. Trial or design-partner access may be modified or revoked at any time. We may suspend access for non-payment after notice.

6. Intellectual Property

ContextGuard and its licensors retain all right, title, and interest in the Service, including all software, detectors, models, and documentation, excluding Customer Content. Feedback you provide about the Service may be used by us without restriction or obligation.

7. Confidentiality

Each party will protect the other’s confidential information with at least the same degree of care it uses for its own confidential information of similar nature, and will use it only to perform under these Terms.

8. Disclaimers

The Service is provided “as is.” Detection, redaction, and blocking are best-effort based on the policies you configure; ContextGuard does not guarantee that the Service will detect or prevent every violation, and it is not a substitute for your own legal, compliance, or security review. Except as expressly stated in a written order, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, ContextGuard will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability arising out of these Terms will not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

Either party may terminate for the other party’s uncured material breach after 30 days’ written notice. You may stop using the Service at any time; fees already due remain payable. Sections that by their nature should survive termination (including Sections 6 through 9) will survive.

11. Governing Law

These Terms are governed by the laws of the jurisdiction stated in your order form, without regard to conflict-of-law principles, unless otherwise agreed in a signed agreement between you and ContextGuard.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify account administrators. Continued use of the Service after changes take effect constitutes acceptance.
